1. General information

1.1 We are GTS ehf. ('Company', 'we', 'us', or 'our'), a company registered in Iceland at Fossnes C, Selfoss, Sveitarfélagið Árborg 800.GTS ehf. operates public bus services in Reykjanesbær on the basis of a service agreement with the municipality. GTS also maintains the GTS mobile application (the “App”), which is a mobile application through which individuals can purchase and manage tickets and period passes and use them to pay for travel on public buses in Reykjanesbær.

The App is an account-based ticketing system in Reykjanesbær. Customers can purchase fares with three fare mediums: cash payment, POS payments and the App.You can contact us by phone at (+354)480 1200 or email at gts@gts.is.1.2 These Terms and Conditions (“Terms”) apply to the App and the services provided by GTS. By downloading, accessing, or using the App, you confirm that you have reviewed, understood and accepted these terms as a binding agreement between you and GTS.

 1.3 We will provide customers with prior notice of any scheduled changes to the Services as outlined in these Terms. Such notices will be sent via the App or other verifiable means. Changes to these Terms will become effective seven (7) days after the notice is given, except if the changes apply to security updates, and bug fixes, in which case the changes will be effective immediately. Continued use of the Services after the effective date of any changes constitutes an approval of the user for the modified terms.

2. Fares and tickets

2.1 Fare Structure

The GTS app provides the following fare options:

Single Fare:

Time period passes:

•Monthly pass for adults

•Annual pass for adults

•Annual card for children

 

2.2 Discounted Fares

2.2.1 Conditions for Discounted Fares

Discounted fares are available for the following groups:

  • Annual pass for youth (ages 12–17)
  • Annual pass for students aged 18 and over
  • Annual pass for people with disabilities
  • Annual pass for seniors aged 67 and over

It is not possible to purchase period passes at discounted rates in the GTS app. Period passes at discounted rates can be purchased at the following locations: Swimming Pool at Sunnubraut (Sundmiðstöð við Sunnubraut), Njarðvík Sports Centre (Íþróttamiðstöð Njarðvíkur), Stapaskóli Sports Centre (Íþróttamiðstöð Stapaskóla), and the Reykjanesbær Main Library - Hljómahöll (Aðalbókasafn Reykjanesbæjar - Hljómahöll).

 

2.2.3 Use and confirmation of discount fares

·      Discounted fares may only be used by eligible discount holders. Others are not permitted to use this fare.

·      Drivers or inspectors acting on behalf of Reykjanesbær may require passengers to verify their eligibility for a discounted fare. If valid proof is not presented, this may result in denial of service or the imposition of fines.

·      The passenger must always give the driver or inspector the opportunity to verify that the correct fare has been paid.

 

2.3 Payments and tickets

2.3.1 Forms of payment:

We accept the following forms of payment: •  VISA •  Mastercard •  Apple pay •  Google pay •  Cash •  POS payments You agree to provide current, complete, and accurate purchase and account information for all purchases made via the services that GTS provides according to these Terms. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed.

All payments shall be in Icelandic Krona. We reserve the right to make changes to fare prices at any time, in accordance with changes to Reykjanesbær’s price lists. Tax will be added to the price of purchases as applicable by Icelandic law at any given time. You agree to pay the price for the service, which is in effect at the time of your purchase, and you authorise us to charge your chosen payment provider for any such amounts upon placing your order. We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment. We reserve the right to refuse any order placed through the Services. We may, in our sole discretion, limit or cancel purchased services if the user has misused the services or violated these terms, for example by buying discounted fares without being eligible for such fares.

2.3.2 POS Payments

·      Contactless payments are transactions made by tapping a contactless debit or credit card or using a device (such as a phone) with Apple Pay or Google Pay, on a payment terminal.

·      Payments can be made with Visa and Mastercard

·      When you pay on the POS, you receive a ticket/receipt with a time stamp. This ticket is valid for 90 minutes from the time of purchase.

·      To avoid the need to carry and present physical tickets, we recommend using the App, where your ticket can be scanned digitally.

 

2.3.3 Cash Payments

  • Cash payments are accepted for purchasing single fares directly from the driver or at designated ticket points.
  • Only exact change is accepted; drivers do not provide change.
  • If you pay with cash, you receive a ticket/receipt with a time stamp. This ticket is valid for 90 minutes from the time of purchase.

2.3.4 The App

  • The App is available for smart phones on the App Store and Google Play.
  • In the App, customers can purchase single tickets or time-period passes for GTS buses in the Reykjanesbær area.
  • Fares in the App are activated when the customer selects “Activate ticket” (“Virkja miða”) in the App. The fare is valid for 90 minutes after the initial activation.

2.4 Tickets and time period passes

2.4.1 General rules

  • To board the buses of GTS, you must hold a valid ticket, time period pass or other valid payment medium.
  • Tickets and time period passes are only valid in the Reykjanesbær Area.
  • Change-over tickets cannot be obtained when paying by the App; this applies both to the holder of the smart device in question and those accompanying them on the same ticket.

2.4.2 Tickets

  • Single tickets are valid for 90 minutes, whether purchased as electronic tickets via the App or as printed tickets.
  • Electronic tickets are valid for 90 minutes from the time of activation in the App.

Printed tickets are valid for 90 minutes from the time of issue.

  • Within the 90-minute window, you may present the ticket to the driver when switching buses. If you lose the ticket or the ticket expires, you must pay for a new fare.

2.4.3 Time period passes  

  • Monthly passes are valid for one (1) month.
  • Annual passes are valid for one (1) year.
  • The validity period of time period passes begins from the time of purchase and these passes do not require special activation in the App.  

3. The App

3.1 The App may be used for devices that support iOS or Android operating systems (hereinafter referred to as smart devices).

3.2 You can choose between logging into the App with a phone number or email. By logging in with a phone number or email, the user ensures that tickets, monthly and/or annual passes are always registered to that phone number or email and will therefore not be lost.

3.3 Smart devices must be connected to the Internet when a product is purchased. Smart devices are also subject to Internet connection, sufficient battery life and an unbroken screen when a product is activated and scanned on board the bus. It is your responsibility to ensure that there is Internet connection, sufficient battery life of the phone and unbroken screen.

3.4 Tickets or time period passes, purchased in the App, are presented to a scanner at the entrance of the bus when the customer enters the bus. The product must be activated prior to the passenger entering the bus.

3.5 Copying or forging tickets in the App is illegal. Offenders discovered using forged tickets or cards will be reported to the police.

3.6 Products in the App may be purchased by using credit and debit cards, i.e. VISA, MasterCard, Apple Pay and Google Pay.

3.7 The value of purchased products is charged to the customer’s credit or debit card when the product is sent to the smart device.

3.8 When payment cards are registered for the App service, they are converted over to a virtual number sequence in the web services of the payment processing company (Rapyd). The payment card numbers are thus stored in a secure manner provided by the payment processor. GTS is not responsible for credit card information sent to a payment processor through the App.

3.9 Charges for purchased single fares and time period passes are carried out in accordance with Reykjanesbær’s price lists at the time they are applied.

3.10 GTS reserves the right to send the users of the app notifications by means of text messages regarding the services of the App.

3.11 Only the account holder is permitted to use their access to the App. The account holder is strictly prohibited from allowing any third party to use their account.

3.12 GTS reserves the right to remove access to the App from a particular smart device or user account without notice if there is reason to suspect that the user of the App has misused the services or provided incorrect information when registering.

3.13 We are the owner and/or the licensee of all intellectual property rights in our Services, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics in the Services, as well as the trademarks, service marks, and logos contained therein. Any breach of these intellectual Property Rights will constitute a material breach of our Terms and your right to use our Services will be terminated immediately.

4. Refunds and Ticket Validity

4.1 Refunds will not be provided for ticket purchases, except as expressly stated in these terms.

4.2 If a technical issue prevents the issuance or display of a ticket or receipt despite a successful payment, the passenger will not be denied boarding solely for that reason, provided that he can present satisfactory evidence of the payment or error (for example, a payment confirmation, bank statement, or error screen) to the driver or inspector.

4.3 The user is responsible for ensuring that the smart device is functioning, has sufficient battery, and can display the necessary information when requested.

5. Limitation of Liability

We work hard to make our services reliable, but like any app, issues can sometimes occur. To the extent permitted by Icelandic law:

5.1 Our responsibility to the user is limited to the amount that was paid for the specific ticket or service in question.

5.2 GTS reserves the right to cancel or amend trips due to unforeseen circumstances beyond the company’s control, such as adverse weather or strikes. GTS is not responsible for delays or cancellations caused by such circumstances. We will provide users with prior notice of any scheduled changes to the Services that they are using.

5.3 We are not liable for indirect losses, such as lost time, profits, or data, beyond what Icelandic consumer protection laws require.

5.4 Icelandic law provides you with certain rights regarding faulty services. If you have a claim, we’ll handle it fairly in line with those protections.

6. Data protection and the processing of personal data

6.1 We care about the protection and security of your personal data. We process your personal data in accordance with the app’s Privacy Policy, which is available here: (link).

6.2 The app’s Privacy Policy forms an integral part of these terms and conditions.

Smart devices are also subject to Internet connection, sufficient battery life and an unbroken screen when a product is activated and scanned on board the bus. It is your responsibility to ensure that there is Internet connection, sufficient battery life of the phone and unbroken screen.

3.4 Tickets or time period passes, purchased in the App, are presented to a scanner at the entrance of the bus when the customer enters the bus. The product must be activated prior to the passenger entering the bus.

3.5 Copying or forging tickets in the App is illegal. Offenders discovered using forged tickets or cards will be reported to the police.

3.6 Products in the App may be purchased by using credit and debit cards, i.e. VISA, MasterCard, Apple Pay and Google Pay.

3.7 The value of purchased products is charged to the customer’s credit or debit card when the product is sent to the smart device.

3.8 When payment cards are registered for the App service, they are converted over to a virtual number sequence in the web services of the payment processing company (Rapyd). The payment card numbers are thus stored in a secure manner provided by the payment processor. GTS is not responsible for credit card information sent to a payment processor through the App.

3.9 Charges for purchased single fares and time period passes are carried out in accordance with Reykjanesbær’s price lists at the time they are applied.

3.10 GTS reserves the right to send the users of the app notifications by means of text messages regarding the services of the App.

3.11 Only the account holder is permitted to use their access to the App. The account holder is strictly prohibited from allowing any third party to use their account.

3.12 GTS reserves the right to remove access to the App from a particular smart device or user account without notice if there is reason to suspect that the user of the App has misused the services or provided incorrect information when registering.

3.13 We are the owner and/or the licensee of all intellectual property rights in our Services, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics in the Services, as well as the trademarks, service marks, and logos contained therein. Any breach of these intellectual Property Rights will constitute a material breach of our Terms and your right to use our Services will be terminated immediately.

4. Refunds and Ticket Validity

4.1 Refunds will not be provided for ticket purchases, except as expressly stated in these terms.

4.2 If a technical issue prevents the issuance or display of a ticket or receipt despite a successful payment, the passenger will not be denied boarding solely for that reason, provided that he can present satisfactory evidence of the payment or error (for example, a payment confirmation, bank statement, or error screen) to the driver or inspector.

4.3 The user is responsible for ensuring that the smart device is functioning, has sufficient battery, and can display the necessary information when requested.

5. Limitation of Liability

We work hard to make our services reliable, but like any app, issues can sometimes occur. To the extent permitted by Icelandic law:

5.1 Our responsibility to the user is limited to the amount that was paid for the specific ticket or service in question.

5.2 GTS reserves the right to cancel or amend trips due to unforeseen circumstances beyond the company’s control, such as adverse weather or strikes. GTS is not responsible for delays or cancellations caused by such circumstances. We will provide users with prior notice of any scheduled changes to the Services that they are using.

5.3 We are not liable for indirect losses, such as lost time, profits, or data, beyond what Icelandic consumer protection laws require.

5.4 Icelandic law provides you with certain rights regarding faulty services. If you have a claim, we’ll handle it fairly in line with those protections.

6. Data protection and the processing of personal data

6.1 We care about the protection and security of your personal data. We process your personal data in accordance with the app’s Privacy Policy, which is available here: (link).

6.2 The app’s Privacy Policy forms an integral part of these terms and conditions.
